5.1 Nature of Services
Our Services may include the use of automation, which can violate the terms and conditions of third-party social media platforms. By using our services, you acknowledge that you understand the risks associated with such tools, and you agree that Heaven.cx is not liable for any consequences, including but not limited to account suspension or banning, that arise from your use of our Services.
6. Use of Our Services
6.1 Compliance with Social Media Platform Policies
You understand and acknowledge that using our Services may be against the policies of third-party social media platforms. Heaven.cx provides tools that may violate these terms, and as such, we make no guarantees regarding the continued functionality of your social media accounts.
6.2 User Responsibility
You accept full responsibility for any consequences, including but not limited to account suspension, termination, or penalties, resulting from your use of our services. You agree to hold Heaven.cx harmless from any claims, legal actions, or damages that may result from using our Services in violation of platform policies.
7. Payment and Refund Policy
7.1 Payments
All payments made to Heaven.cx are final. We accept payments via authorized payment gateways, and all charges for our Services must be paid upfront.
7.2 No Refunds
As a general policy, we do not provide refunds under any circumstances. This includes, but is not limited to, cases where social media platforms alter their algorithms, disable user accounts, or change their policies in ways that affect the performance of our services.
7.3 Refund Exceptions
Refunds may only be considered in exceptional circumstances, solely at the discretion of Heaven.cx. Any refund request must be submitted within 48 hours of payment, accompanied by supporting documentation. Refunds will only be granted if there is conclusive evidence that no service was delivered due to a technical failure on our part.
7.4 Chargebacks and Disputes
Attempting to file chargebacks or payment disputes without first contacting us for resolution will result in immediate termination of your Account, and you may be banned from future use of our services. We reserve the right to contest any fraudulent chargebacks or disputes and may seek legal recourse, including collection of damages, if necessary.
8. Limitation of Liability

Heaven.cx provides its Services on an "as is" and "as available" basis. We do not guarantee any specific results, and we are not responsible for any interruptions, delays, or other technical issues that may arise. Heaven.cx disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
8.2 Limitation of Damages
In no event shall Heaven.cx, its owners, employees, or affiliates, be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use our services. This includes but is not limited to damages for lost profits, account suspension, business interruption, loss of data, or any other financial losses.

You agree to indemnify and hold harmless Heaven.cx, its affiliates, and its employees from any and all claims, damages, liabilities, expenses, and legal fees that arise from your use of our services, your violation of these TOS, or your violation of any applicable laws or third-party rights.
10. Intellectual Property Rights

All content, software, designs, and intellectual property provided by Heaven.cx are the exclusive property of the Company. You agree not to reproduce, distribute, modify, or create derivative works based on our content without express written permission.
10.2 User-Generated Content
Any content generated or submitted by Users through our Services (such as automated comments or interactions) is the responsibility of the User. Heaven.cx does not claim ownership of such content, but we reserve the right to monitor and remove any content that violates these TOS or applicable laws.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the current state. You agree that any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in the current state.
