Instagram Giveaway Rules: How to Run One and Pick a Winner

Instagram's promotion rules require a release and a not-sponsored note, and ban inaccurate tagging. How to run a giveaway and pick a winner fairly.

You can run a giveaway on Instagram, but Instagram's Promotion Guidelines make you responsible for it. They say that if you use Instagram for "a contest or sweepstakes," you're responsible for the lawful running of it. Your rules must include "A complete release of Instagram by each entrant or participant." They also need an "Acknowledgement that the promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram." And you can't push people to tag content wrongly. Asking entrants to tag friends in the comments is fine. Telling them to tag themselves in a photo they're not in isn't.

We read Instagram's Promotion Guidelines and the guides as Google shows them on October 23, 2026. This is a guide to Instagram's rules, not legal advice, and contest law differs by country.

Postora's September 2026 guide clears up a common worry: "Instagram's Promotion Guidelines do not ban tagging friends, only inaccurate tagging." For the not-sponsored note, Woobox suggests one plain line: "This promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram." Postora also points out that "Meta's Spam policy lists cash giveaways for engagement," so think twice before offering cash for likes and follows.

How do you run a giveaway on Instagram?

  1. Pick a goal and a prize. The prize should suit the followers you want.
  2. Choose how to enter. Liking, following, commenting or tagging a friend are the usual ways.
  3. Write the official rules. Cover who can enter, the dates, how you'll pick the winner and the Instagram release.
  4. Post it. A Reddit user who looked at more than 100 giveaways wrote in October 2025 that on Instagram, "Photo posts with clear visuals showing the prize work best."
  5. Set a clear end time. WPForms suggests a time limit "visible for your users at all times."
  6. Pick and announce the winner. Do it on the date you promised.

Don't charge to enter. A guide from The Social Media CEO warns that a giveaway with a paid entry "is actually classified as a lottery, which is illegal" in many places.

How do you pick a winner on Instagram?

At random, from the entries that follow your rules. "Instagram giveaway picker" gets about 14,800 searches a month, so a lot of people use a tool that pulls the comments and draws one. Whatever you use, check the winner met every entry rule before you announce, and keep a record of the draw in case anyone asks.

If the winner doesn't answer by the deadline in your rules, draw again. Saying that in the rules up front saves arguments later.

Do Instagram giveaways get you followers?

They can bring a burst of new followers and comments, because entry rules often ask people to follow and tag friends. Some of them only came for the prize, so some may leave once it's over. A giveaway works best on top of steady posting, at the times your followers are online. Our guide to the best time to post on Instagram has the data.
