The rule is "limited to situations in which the buyer knew or should have known that the indicators were fake and misrepresent the buyer's influence or importance for a commercial purpose." Penalties can reach $53,088 per violation, and that amount is unchanged for 2026. Outside the law, TikTok's own rules apply: "We do not allow fake engagement."

The FTC finalized the rule on August 14, 2024. It said the rule lets the agency "seek civil penalties against knowing violators." In December 2025, FTC staff sent warning letters to 10 companies under the same rule, which also covers "misusing indicators of social media influence like the number of followers or views." The FTC added that the letters "are not formal determinations" that anyone broke the rule. Its penalty amounts stay the same in 2026 because the yearly inflation adjustment was canceled.

Business Insider summed it up in August 2024: "The FTC is coming after influencers and brands that buy fake followers." The line to watch is money. If bought followers help you win a sponsorship or charge more for a post, you're in the situation the rule describes.

Can you get banned for buying TikTok followers?

TikTok can act on its own rules. Its policy says "We do not allow fake engagement" and names "selling followers or likes" as part of it. When it finds "inauthentic metrics," it will "remove fake likes, followers, or other inflated signals." We couldn't read its full enforcement rules, so we can't say how it treats one account. What do other answers get wrong?

Several pages that rank for this question still say buying followers is legal everywhere. SMM Rangers calls it "not illegal in any country" on its page. A 2023 Quora answer says nothing in law "anywhere" restricts it. For commercial use in the US, the FTC's 2024 rule says otherwise. Famoid's September 2026 answer is closer: "For a regular person, buying followers is not a crime in most countries."
